Terms and conditions
The rules for using this site and ordering through it. Written so you can read them over a coffee.

This is a translation. The original of this document is written in Polish, and if the two ever differ, the Polish version is the one that applies.
01Who runs this site
The site is run by Kawiarnia Palone Masło Apolonia Doganowska, a sole proprietorship entered in CEIDG, ul. Jedności 3A, 65-018 Zielona Góra, NIP 9292087069, REGON 540340090.

These terms set out the rules for using the site and for ordering coffee and bakes through it. They're available on this page at all times, and before you place an order you confirm that you've read them.
02A few definitions
- Café
- Palone Masło, meaning us.
- Site
- This website together with all its pages.
- Customer
- Anyone who uses the site or places an order.
- Consumer
- A customer who is a natural person ordering for a purpose not directly related to their business or profession. The same rights apply to a sole trader with consumer rights, meaning a natural person who enters into a contract directly related to their business, where the contract is not of a professional nature for them.
- Account
- A free customer account on the site. Orders are placed from an account.
- Advance order
- An order for a product from our range, placed and paid for through the site, and picked up in person at the café on the chosen day.
- Special order
- An order for something that isn't in our range, for example for an occasion or for a company. It starts with a request, and the details, price and date are agreed in a conversation on the site.
03What you can do on the site
- browse the site, the menu and the photos, without creating an account or giving any data,
- create a free account and place an advance order from it, for pickup at the café on the day you choose,
- ask about a special order and agree it with us in a conversation on the site.
The menu on the site gives the prices of drinks at the café. Bakes and what's available change from day to day, so the menu has no prices for bakes. The binding prices and contents of an order placed through the site are shown in the summary before payment, and it's best to ask us directly about allergens.
04Your account and technical requirements
You place orders from your account. You create it by giving an email address and a password, and you confirm the address with a link we send you. The account is free. When you create it, we enter into a contract for providing an electronic service, namely running the account, for an indefinite period.
You can delete your account yourself at any time, on your account page, with the “Delete account” button and by entering your password again, or by writing to us. Deleting the account ends this contract. While an order on the account is waiting for payment, waiting to be picked up or still being agreed, the account can only be deleted once that order is finished. The data of settled orders stays for as long as tax law requires.
All you need is a device with internet access and an up-to-date browser with JavaScript enabled and with the cookies the site needs to work allowed. To get an order confirmation, you need the means of contact you give when you order.
Using the internet comes with the usual risks, such as malware or sites pretending to be someone else's. We look after the site's security, and you look after keeping your device up to date and being careful with links.
You may not put unlawful content on the site, impersonate other people or disrupt how the site works.
05Advance order
- You choose a product from our range, the pickup day and how it should be prepared, and give the details we need to contact you.
- Before confirming, you see a summary: what you're ordering, how much it costs and for which day.
- You click the “Order and pay” button, which means placing an order with an obligation to pay, and you pay online.
- Once your payment is received, you get confirmation that your order has been accepted. That's the moment the contract is made.
- You pick up the order at the café on Jedności 3A on the day you chose, during opening hours.
We don't ship orders placed through the site. The only way to get them is to pick them up in person at the café, ul. Jedności 3A, 65-018 Zielona Góra, so we don't add any delivery costs to the price.
Each product has its own rules, shown when you order: how far ahead it has to be ordered, on which days it can be picked up and how many we make in a day. Once the limit for a day is reached, that day can no longer be chosen.
After placing an order, you have 30 minutes to pay. During that time we hold your place in the day's limit. If the payment doesn't go through, the reservation expires and the place goes back into the pool.
If for any reason we can't fulfil a paid order, we'll let you know as soon as we can and refund the full amount you paid.
Your order waits for you until the end of the day it was due to be picked up. Fresh bakes don't keep for long, so after that we can't hand them over or give you a refund for them.
06Special order
A special order is for something that isn't in our range. You describe what you need, and we reply with a proposal that includes the price and the date. Until we've agreed, we can change it, and each new proposal replaces the one before. Sending a description doesn't settle anything yet.
The contract is made when you accept our proposal and pay for it. You pay the full amount online, the same way as for an advance order, and you pick up the order the same way too: in person at the café, on the agreed day.
If you want to cancel after paying, write to us as soon as possible. If we haven't started preparing your order yet, we'll refund the full payment.
07Prices and payments
All prices on the site are in Polish złoty and include VAT. The binding price is the one you see in the order summary.
Online payments are handled by Przelewy24. You choose how to pay when you order, from the methods available at the time, or on the Przelewy24 page you're taken to after clicking “Order and pay” or “Pay”. Payments are settled on Przelewy24's terms, and we have no access to your card or bank account details. We don't charge any fees for the payment method.
You pay for an advance order straight away, when you place it. You pay for a special order after you accept the price we give you in the conversation. If we refund you, for example when we can't fulfil an order or after a complaint is upheld, the money goes back the same way it was paid, through Przelewy24.
If you need a company invoice, say so when you order and give the company details before paying. Once a receipt has been issued without a tax number (NIP), we can no longer issue a company invoice for it.
Once you've paid, you can download an order and payment confirmation as a PDF from the order's page. It isn't a fiscal receipt or an invoice. We give you the receipt when you pick up at the café, and we issue a company invoice after payment and send it to the email address on the order.
08Withdrawing from the contract
When shopping online, a consumer usually has 14 days to withdraw from a contract without giving a reason. For food and drink, however, the law makes exceptions, and they cover our orders.
Under Article 38(1)(4) of the Polish Consumer Rights Act, there is no right of withdrawal from a contract for goods that spoil quickly or have a short shelf life. This covers fresh bakes, including cheesecakes and croissants.
Under Article 38(1)(3) of the same Act, there is also no right of withdrawal when the contract is for goods made to the consumer's specifications or to meet their individual needs. Special orders are exactly that.
That doesn't mean a problem is left for you to deal with. If something's wrong with your order, write to us or tell us at the counter, and we'll sort it out.
09Complaints
If your order doesn't match the contract, for example there's something in the bag other than what you ordered, or a product is faulty, make a complaint. Just send a message describing what happened, with your order number or date and what you'd like us to do.

We reply within 14 days. We're responsible for the goods being in line with the contract under the rules in Chapter 5a of the Polish Consumer Rights Act. With food, it's worth reporting a problem straight away, because after a few days it's hard to tell what went wrong.
10A dispute we couldn't settle by talking
Let's first try to sort it out directly. That's usually enough. If we still can't agree, as a consumer you can use out-of-court ways of dealing with complaints and pursuing claims:
- asking the permanent consumer arbitration court at the provincial inspector of the Trade Inspection (Inspekcja Handlowa) to settle the dispute,
- asking the provincial inspector of the Trade Inspection to start mediation,
- free help from a municipal or district consumer ombudsman or a consumer organisation,
- information and guidance on the website of the Office of Competition and Consumer Protection: uokik.gov.pl.
Using them is voluntary for both sides. We're not bound by any code of good practice within the meaning of the Polish Act on Counteracting Unfair Market Practices.
11Personal data and copyright
How we process personal data is described in the privacy policy, and cookies in the cookie policy.
The photos, texts, logo and the whole look of the site are protected by copyright. You may use them within the limits of permitted personal use. Using them in any other way requires our consent.
12Finally
Matters not covered by these terms are governed by Polish law, including the Civil Code, the Consumer Rights Act and the Act on Providing Services by Electronic Means. These terms don't limit any rights a consumer has under the law.
We may change these terms, for example when we change how we take orders or when the law changes. Orders placed before a change are fulfilled under the rules that applied when they were placed. The new version applies from the day it's published on this page.
